DWI CONDITIONAL RESTORATION HEARING

If you receive two DWI’s within three years (from conviction date of the first offense to the offense date of the second charge), you will face a four year license suspension. Attorney Haddock can help you request a DMV hearing to have your license conditionally restored after two years. That conditional restoration will include the requirement of ignition interlock for three years.


HIGH SPEED AND MOVING VIOLATION REVOCATION HEARINGS

Facial Recognition DMV Hearing

North Carolina DMV now has software that runs the images associated with each licensed driver. This program screens photos from up to 20-30 years ago. If the software finds a discrepancy in the photos, such as an image that does not appear to be the same as the rest of the images, a license suspension gets triggered.



IGNITION INTERLOCK VIOLATION HEARING

DMV requires ignition interlock for drivers whose licenses are restored following a conviction for DWI if: 

  • You had an alcohol concentration of 0.15 or higher; or

  • You were convicted of a second offense of DWI, which happened within seven years of the offense for which your license was revoked; or

  • You were sentenced to an Aggravated Level One DWI


MEDICAL REVIEW PROGRAM

Were you in a car accident and questioned by police regarding your medical condition? Or, is your doctor questioning your fitness to drive? Both law enforcement, and medical practitioners may submit your license for review by the Medical Review Program.


Refusal REvocation Hearing

If you are charged with a DWI and refuse to blow into the official breath test you will receive a letter in the mail revoking your license for one year. Your license will be revoked for that one year regardless of whether you are found guilty or not guilty of your underlying DWI charge.



DRIVING WHILE LICENSE REVOKED- PERMANENT REVOCATION HEARING

Why is your license revoked? Maybe you failed to pay a ticket many years ago and then got a few traffic tickets while your license was suspended. Or, maybe you failed to appear for court and have since been charged for driving without a license. It may seem hopeless to get out of the cycle of suspensions. It is important to remember that the sooner you work to end the cycle the sooner you can be licensed again.


CDL DISQUALIFICATION AND VIOLATION HEARINGS

If you have a Commercial Drivers License (CDL), you are held to a higher standard. Traffic tickets and other moving violations have a much harsher impact for CDL holders than for the typical Class C driver. Your points count double for moving violations which puts you at a much higher risk for a points related revocation.
